What is a Bankruptcy Discharge?
In Texas, if you are about to file for bankruptcy, you are likely to have heard some terms that you are not familiar with. One of these terms – a bankruptcy discharge – is likely the primary reason you have decided to file in the first place.
Depending on the type of bankruptcy you file under, you will be able to discharge some to most of your debts. This means that upon successful completion of the terms of your bankruptcy, the judge will release the remaining portion of your debts. These are usually limited to unsecured debts, such as credit card loans, that you will never be responsible for paying off.
Another benefit of bankruptcy is the prevention of further harassment by creditors. When you first file for bankruptcy, you will be given an automatic stay by your bankruptcy judge. Once the judge has approved the terms of your bankruptcy, an automatic stay will prevent creditors from harassing you any further. As long as you make your monthly payments, creditors are not allowed to have any contact with you, although they can speak to your San Antonio bankruptcy lawyer at any time.
