Couple Challenges Bank's Foreclosure

Even though a couple is offering to make mortgage payments on their property, the bank is still insisting that it will foreclose on them.

The two have filed a lawsuit in Jefferson County, Texas against the mortgage provider and associated banks. They claim that even though they have made some payments to pay down their current debts, as well as contacted the bank to announce their intention to keep paying, the bank is going ahead with the foreclosure proceedings.

When Hurricane Katrina hit, their home was one of the properties affected. At that time, the couple worked out a payment deferral plan to deal with the property damage that was incurred. Yet for some reason, the couple now claims that the new payment plan is faulty and does not allow them enough time to make the payments required to keep their home. They claim that the bank breached the contract and violated a state act protecting consumers like them.
