Will Frank McCourt Be Able to Keep the Dodgers?
Baseball fans have been watching with baited breath to see whether Frank McCourt will bring his team, the Los Angeles Dodgers, to bankruptcy court.
Rather than be stripped of his beloved team, McCourt could regain the funding and authority to keep his team if he is successful in declaring bankruptcy. However, some legal experts believe that he will immediately run into problems should McCourt opt for bankruptcy, as the Major Baseball League could use a "voluntary termination" clause against him. This would revoke the franchise of the team should they opt for bankruptcy. However, when deciding his bankruptcy status, the court will not consider MLB rules when doing so.
McCourt's ex-wife, Jamie, could also make it difficult to claim bankruptcy for the team as she has a half-ownership stake in it.
