Supreme Court Grants Review to Malaise Law Firm Bankruptcy Case
Justices Will Weigh In on Undistributed Funds Issue

lawyers at the malaise law firm appear before the us supreme courtSan Antonio, TX: The United States Supreme Court has agreed to review a case to decide whether undistributed funds held by a Chapter 13 trustee go to creditors or return to the debtor once the bankruptcy is converted to Chapter 7. This issue has split appellate courts and has caused disagreements in bankruptcy courts for over 30 years.

The Supreme Court only chooses to review a handful of bankruptcy cases each year, so this review will be closely watched by bankruptcy practitioners around the nation. Briefs have been filed and oral arguments are scheduled for April 1, 2015. Todd Malaise, owner of Malaise Law Firm, will serve as co-counsel.
